Acceptance of Terms
By accessing or using TrainTrack, you agree to be bound by these Terms of Service. If you do not agree, please do not use the application. These Terms of Service constitute the End User License Agreement (EULA) between you and TrainTrack.
Service Description
TrainTrack is a fitness tracking application that enables you to log workouts, track nutrition, monitor body progress, and analyze your fitness journey. The app works offline and syncs data across your devices.
User Accounts
You are responsible for maintaining the security of your account credentials. You must provide accurate information and promptly update any changes. You are responsible for all activity under your account.
Acceptable Use
You agree not to: use the service for any unlawful purpose, attempt to gain unauthorized access to our systems, interfere with other users' use of the service, upload malicious content or code, or reverse engineer the application.
Subscriptions and Auto-Renewal
TrainTrack offers auto-renewable subscriptions that grant access to premium features. Subscription length and price are displayed at the point of purchase. Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew at the end of each period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store or Google Play account settings. New users may be offered a free trial; if you do not cancel before the trial ends, your subscription will begin and you will be charged. No refund is provided for the unused portion of any subscription period, except where required by law.
Apple-Specific Terms
If you obtain TrainTrack through the Apple App Store, you acknowledge that these Terms are between you and TrainTrack only, and not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for TrainTrack. In the event of any failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to TrainTrack. Apple is not responsible for addressing any claims by you or any third party relating to TrainTrack, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Health Disclaimer
TrainTrack is a fitness tracking tool, not a medical device. Always consult a healthcare professional before starting any exercise or nutrition program. We are not responsible for any injuries or health issues resulting from workouts logged in the app.
Intellectual Property
The TrainTrack application, including its design, code, and content, is owned by us and protected by intellectual property laws. Your workout data and personal content remain yours.
Termination
We may suspend or terminate your access to TrainTrack at any time for violation of these terms. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.
Limitation of Liability
TrainTrack is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.
Governing Law and Export Compliance
These Terms are governed by the laws of the jurisdiction in which TrainTrack is operated, without regard to its conflict-of-law provisions. You represent and warrant that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of prohibited or restricted parties. If you are a U.S. Government end user, TrainTrack is a Commercial Item as defined under applicable U.S. federal acquisition regulations.
Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes through the app or via email. Continued use after changes constitutes acceptance.
